The Missouri Supreme Court made the appointment Friday Judge John P. Torbitsky The Eastern District of Missouri Court of Appeals to review Missouri Attorney General Andrew Bailey’s legal action to remove St. Louis Circuit Attorney Kim Gardner from his elected position as St. Louis Circuit Attorney. A Soros-funded circuit attorney refuses to perform the duties of his position. The homicide rate and car thefts in St. Louis rival those of any major city in a third-world country. Gardner refuses to prosecute criminals and releases dangerous criminals on the street. And at the same time, they throw out court cases because they say the police are racist.
Last weekend a repeat offender, 21-year-old Daniel Riley, who was out on bail after violating his bond multiple times, killed teenager Janay Edmondson in a wreck. A young teenage volleyball sensation lost both of her legs while walking from a volleyball tournament with her parents in downtown St. Louis. Janey had a scholarship to play volleyball in college. Daniel Riley had violated his bond more than 100 times and was still roaming the streets of St. Louis.
A St. Louis city judge on Thursday asked the state Supreme Court to exclude Kim Gardner from deciding to keep him as circuit attorney. This frees him to testify against Kim Gardner in her case.
The St. Louis Post-Dispatch reported:
A city judge on Thursday referred St. Louis Circuit Attorney Kimberly M. to the Missouri Supreme Court. Gardner asked to be excluded from deciding whether to remove him from office, arguing that he had a conflict of interest.
Missouri Attorney General Andrew Bailey filed a lawsuit in St. Louis alleging Gardner was negligent in office and seeking his removal from office.
Hogan said all judges on the court’s advisory panel can be called to testify during the trial and therefore cannot preside over the case, according to the filing.
The Supreme Court ultimately decides whether to approve the request and appoint a judge from another jurisdiction.

Again – here’s a little more background on Kim Gardner.
In August 2018, Kim Gardner announced that her attorney would no longer accept cases from 28 different St. Louis City police officers. Gardner called it his “exclusion list” because he was racist.
Gardner didn’t tell the authorities what he did to get on their list but he was being censored.
In 2019, Gardner refused to charge a drug dealer with 1,000 opiate pills and 30,000 in cash because she didn’t like the police involved.

And Gardner declined to charge the 7-year-old’s killer despite the suspect’s confession in 2019.

Gardner lied about the case against Governor Eric Greitens, committed more than 60 misdemeanors in the case, and got away with it.
In 2020 Kim Gardner dropped the case against a suspect who shot another man in a traffic dispute in broad daylight.
