Trump’s lawyers on Monday moved to quash the Georgia special grand jury report and expunge it from the record.
President Trump’s lawyers blasted the special grand jury, calling it “confusing, flawed, and at times, plainly unconstitutional.”
Trump’s lawyers asked a Georgia court to prevent Fulton County DA Fannie Willis from using the special grand jury report as evidence as it considers the Ricoh charges against Trump.
Fulton County DA Fannie Willis is considering Ricoh and conspiracy charges against Trump over his efforts to challenge the 2020 election, according to a leak to CNN.
A Georgia special grand jury investigating Trump’s attempt to challenge the 2020 election recently recommended multiple indictments after meeting for several months.
Fannie Willis is now considering racketeering and conspiracy charges against Trump because of so-called ‘evidence’ that Trump’s effort to challenge the election in Georgia did not originate in the state as a grassroots movement.
Trump’s legal team has urged Fulton County DA Fannie Willis’ office to recuse herself from any investigation involving Trump, CBS reported.
“The scrutiny and gravity of the investigation and the individuals involved — namely, the moving President Donald J. Trump, should have conducted this process properly, fairly and with respect for the law and the highest ethical standards,” Trump’s lawyers said. Written by Jennifer Little and Drew Findling, the outlet reported.
CBS News reported:
Lawyers for former President Donald Trump asked a Georgia court on Monday to suppress the report of a special purpose grand jury that investigated efforts by Trump and his allies to overturn the results of the 2020 presidential election.
In a nearly 500-page filing filed in state court in Fulton County, Ga., Trump’s lawyers criticized the special-purpose grand jury process, calling it “confusing, flawed and, at times, clearly unconstitutional.”
In addition to asking the court to quash the grand jury’s December report, strike it from the record and bar any prosecuting body from using evidence obtained by the grand jury, Trump’s lawyers want to impeach the office of Fulton County District Attorney Fannie Willis. Any further investigation or prosecution of a matter involving Trump.
In their filing in Fulton County Superior Court, Trump’s attorneys argued that the laws governing the special-purpose grand jury were “unconstitutionally vague” and that the judges overseeing the panel applied the laws “in a manner that violates due process rights.” A special purpose grand jury included when he held a criminal grand jury.
Little and Findling criticized the comments made by Emily Kohrs, four women on the grand jury, in interviews with several media outlets, saying they “violate notions of fundamental fairness and due process and taint any future grand jury pool.” Five other jurors spoke with the Atlanta Journal-Constitution about their time on the special purpose grand jury.
“Accordingly, President Donald J. Trump moves to quash the SPGJ’s report and to bar the use of any evidence obtained from it, as it was conducted under unconstitutional law, through an illegal and unconstitutional process, and by a disqualified District Attorney’s office that violated prosecutorial standards and gravity of circumstances and disregarded the constitutional rights of those involved. Acted,” Trump’s lawyer wrote.
